CVS Health Corporation, one of the largest pharmacy chains in the United States, has faced significant legal challenges over the years, many of which resulted in multi-million dollar settlements. These lawsuits span a variety of areas, from its role in the opioid crisis to allegations of overcharging Medicare, improper prescription practices, and unfair business practices. Here’s a deep dive into some of the most prominent legal battles involving CVS and how they have shaped the company’s legal and financial standing.

The Opioid Crisis

In 2022, CVS Health agreed to a historic $5 billion settlement to resolve claims from states, cities, and tribal nations over its role in the opioid epidemic. The settlement was the result of lawsuits alleging that CVS pharmacies contributed to the opioid crisis by filling prescriptions for highly addictive painkillers without proper oversight.

This $5 billion national settlement was part of a broader effort to hold pharmaceutical companies accountable for their role in the opioid crisis. CVS agreed to pay this amount over a 10-year period. The lawsuit accused CVS of recklessly dispensing opioid prescriptions, which led to widespread addiction and overdose deaths across the country.

Before this settlement, in 2015, CVS also settled a related case for $22 million, addressing its role in Florida’s “pill mill” crisis. The company had faced allegations that it allowed fraudulent prescriptions for opioids to be filled at its pharmacies in the state.

Additionally, in December 2024, the U.S. Department of Justice filed a nationwide lawsuit against CVS, accusing the pharmacy giant of knowingly filling unlawful prescriptions for controlled substances, continuing to fuel the opioid crisis.

Healthcare Fraud and Overcharging Medicare

CVS Health has also faced multiple legal issues related to Medicare fraud and overcharging the government for prescription medications. In 2025, CVS Caremark, the company’s pharmacy benefits manager, agreed to pay a $285 million settlement for overcharging Medicare for generic drugs between 2010 and 2016. A further ruling in August 2025 brought the total settlement to $290 million.

In December 2025, CVS was again in the news for settling allegations that it improperly dispensed insulin pens and incorrectly billed government healthcare programs, including Medicare and Medicaid, for premature refills. This settlement was for $37.76 million and came as part of broader efforts to curb improper practices in the healthcare industry.

CVS had also faced previous legal challenges in relation to fraud. In November 2025, the company agreed to pay $18.2 million to resolve claims that it violated the False Claims Act by dispensing controlled substances inappropriately. This was a continuation of its pattern of legal disputes involving fraudulent billing practices.

In 2008, CVS paid $36.7 million to resolve allegations that it unlawfully switched prescriptions for ranitidine (commonly known as Zantac) to a higher-priced version, defrauding Medicaid in the process. These repeated legal challenges highlight CVS’s ongoing struggles with compliance and its impact on government healthcare programs.
