Types of damages that we often see are if there are unauthorized charges to any of your accounts, if you’ve got damage to your credit, or if you lost money—for instance, if somebody went into your bank account and took a direct amount of money out of your account, you’re entitled to get that back.

Time and expense for having to deal with the data breach are also recoverable damages. The types of damages that you could recover in a data breach include unauthorized charges to accounts, somebody going into a bank account and taking your money out, and time and expense for having to deal with the data breach.

If you purchased credit monitoring or medical monitoring, you can get that back. Some states allow you to recover for emotional distress, and some states have statutory damages that you can recover above and beyond.
