VSL Pharmaceuticals, Inc., Leadiant Biosciences, Inc., and Alfasigma USA, Inc. have agreed to a $20 million class action settlement to resolve allegations that they misleadingly marketed a reformulated version of the VSL#3 probiotic using clinical studies performed on the original formula.
If you purchased the high-potency probiotic VSL#3 between June 2016 and June 2019, you may be eligible to receive a cash payment following a $20 million class action settlement.
Everyday people rely on specialty medical foods and dietary supplements to manage serious health conditions, trusting that manufacturers are selling products backed by authentic clinical research. When companies alter ingredients behind the scenes while continuing to market a product as the original formula, consumers pay the price for a product that may not deliver what was promised.
A newly approved settlement addresses allegations that pharmaceutical makers deceptively changed VSL#3 without telling consumers. If you bought the supplement during the specified window, you may be eligible to claim cash compensation.
The legal battle centers around VSL#3, a high-potency probiotic medical food frequently recommended for dietary management of gastrointestinal conditions such as irritable bowel syndrome (IBS) and ulcerative colitis. According to court documents in the case Starr v. VSL Pharmaceuticals, Inc., the companies responsible for manufacturing and distributing the supplement quietly reformulated the product, swapping out key ingredients for cheaper alternatives.
Despite altering the formula, the lawsuit claimed that VSL Pharmaceuticals, Inc., Leadiant Biosciences, Inc., and Alfasigma USA, Inc. continued marketing the probiotic as the exact same product. Plaintiffs argued that the companies deceptively cited older clinical studies performed on the original, authentic formula to promote the newly reformulated version.
The defendants deny any wrongdoing or liability, maintaining that their marketing practices were appropriate. However, rather than continuing through protracted litigation, the parties agreed to establish a $20 million settlement fund to resolve the dispute and provide financial relief to affected buyers.
You may be eligible to participate in this settlement if you purchased VSL#3 in the United States between June 1, 2016, and June 19, 2019.
The settlement offers distinct payout structures depending on whether you retained receipts, store records, or other proof of purchase from years past:
Without Proof of Purchase: If you do not have receipts or records, you can submit a claim for one unit of VSL#3 purchased per household.
With Proof of Purchase: If you have documentation, you can file a claim for three units or the exact total number of units for which you have proof—whichever is greater, up to a maximum of 40 units (or $800).
For the purpose of the settlement, a “unit” is defined as an individual bottle or box of VSL#3, with each bottle in a multipack counting separately. Payout amounts are currently set at $20 per unit, though individual checks may be adjusted upward or downward on a pro rata basis depending on the total volume of valid claims filed.
To ensure you do not miss out on your share of the settlement funds, note these critical dates on your calendar:
