Flagstar Bank, N.A. has agreed to pay $31.5 million in a class action settlement resolving allegations that it failed to protect the sensitive personal records of more than 2.1 million consumers during two separate data breaches in 2021. What Caused the Flagstar Bank Data Breach Lawsuits?

The class action lawsuit, Angus et al. v. Flagstar Bank, N.A., filed in the U.S. District Court for the Eastern District of Michigan, stems from two cybersecurity incidents that Flagstar Bank experienced in January 2021 and December 2021. According to court filings, the breaches exposed the personally identifiable information of approximately 2,187,170 individuals across the United States, including roughly 364,000 residents of California.

Plaintiffs in the consolidated legal action alleged that Flagstar Bank failed to implement and maintain reasonable digital security measures, leaving customer files vulnerable to unauthorized third parties. The compromised records reportedly contained sensitive personal details, including full names and Social Security numbers, stored within the bank’s network systems.

Flagstar Bank denies all claims of legal liability and maintains that it did not do anything wrong. No court or judicial body has ruled that Flagstar Bank acted unlawfully. However, to resolve the litigation and avoid the significant ongoing costs, disruption, and risks of a trial, the financial institution agreed to establish a $31,500,000 settlement fund for affected account holders and consumers.

Who Is Included in the $31.5 Million Flagstar Settlement Class?

You are considered a settlement class member if you are among the approximately 2,187,170 U.S. consumers identified by Flagstar Bank whose personal information was impacted by either the January 2021 or December 2021 data breaches.

The court-approved settlement class includes two main groups:

  • Nationwide Settlement Class: Approximately 2,187,170 individuals nationwide whose personal information was involved in the 2021 security incidents.

  • California Settlement Class: Approximately 364,000 California residents included within the nationwide class who qualify for additional state statutory payments.

If you received an official email or postcard notice regarding the settlement containing a unique Settlement Claim ID, you are formally recognized as a class member and can submit a claim for financial recovery.

What Cash Payouts and Benefits Can You Claim from the Settlement?

The $31.5 million settlement provides several distinct benefit options. Eligible class members can claim one or more of the following recoveries depending on their documented financial losses and location:

1. Reimbursement for Documented Out-of-Pocket Losses (Up to $25,000)

Settlement class members who experienced actual financial harm linked to the data breaches can submit supporting documentation to receive up to $25,000 in cash reimbursement. 2. Residual Cash Payment (Estimated at $60, Up to $599)

All settlement class members can elect on their claim form to receive a pro-rata residual cash payment. While the final distribution depends on the total number of valid claims filed against the settlement fund, administrator estimates put the baseline cash payment at approximately $60, with potential payouts reaching up to $599 per class member.

3. California Statutory Cash Payment (Up to $100)

Class members who resided in California at the time of the data breaches can apply to receive an additional statutory cash payment of up to $100 under California consumer protection laws, over and above any residual or loss reimbursement payouts.

4. Three Years of Free Credit Monitoring Services

Every settlement class member can enroll in three years of complimentary, three-bureau credit monitoring through IDX. This service includes dark web monitoring, fully managed identity restoration assistance, $1,000,000 in identity theft insurance, and lost wallet protection.

  4. Select your preferred cash payout options and check the box to enroll in the free three-year credit monitoring service.

  5. If claiming documented financial losses of up to $25,000, upload supporting documentation such as bank statements, fraud notices, or receipts.

  6. Submit your claim online or ensure your mailed claim form is postmarked no later than August 11, 2026.

The court will hold a final approval hearing on October 1, 2026, to decide whether to approve the settlement terms. Monetary payments and credit monitoring enrollment codes will be distributed after the court grants final approval and any legal appeals are resolved.
