Some customers allege that GUESS engaged in deceptive email-marketing practices by using misleading subject lines to encourage them to open and act on promotional messages. When GUESS sent emails with subject lines stating or suggesting that a sale, discount, or promotion was ending, expiring, or available for a limited time, some customers claim these emails were followed by extensions or similar offers that remained available after the deadline had supposedly passed. Additionally, some customers allege that GUESS sent emails offering unqualified discounts or free gifts when a minimum purchase was actually required to receive the offer. The claims allege these practices were misleading and deceptive under consumer-protection laws in the District of Columbia, Indiana, Kansas, Maryland, North Dakota, and Washington.
