ABC Legal Services Agrees to $2.5 Million Settlement Over 2024 Data Breach Exposing Private Information

The lawsuit alleged that the company failed to safeguard highly sensitive consumer records, leaving personal, financial, and government identification details exposed to unauthorized third parties.

What Caused the ABC Legal Services Cybersecurity Incident?

The class action litigation arises from a security breach that occurred on or around August 7, 2024, which ABC Legal Services discovered in November 2024. According to court documents filed in the U.S. District Court for the Western District of Washington, an unauthorized actor gained access to internal systems housing confidential consumer records.

Data breach disclosures filed with state regulatory agencies revealed that the incident impacted approximately 245,808 people across the United States. The exposed files contained extensive personal identification details, including full names, Social Security numbers, driver’s license numbers, state identification cards, passport numbers, financial account details, dates of birth, and health insurance information.

Affected consumers filed a consolidated class action lawsuit (In re: ABC Legal Services Data Security Incident, Case No. 2:24-cv-02092), claiming that ABC Legal Services was negligent in its duty to maintain robust cybersecurity safeguards. The suit asserted claims for unjust enrichment, breach of implied contract, and violations of state consumer protection statutes in New York, Oregon, and Washington. ABC Legal Services denies all allegations of liability and legal wrongdoing, maintaining that it acted responsibly. Both parties agreed to the $2.5 million settlement fund to avoid the cost, delay, and uncertainty of taking the complex matter to trial.

  • Pro Rata Cash Payment: Class members can elect to receive a basic cash payment instead of—or in addition to—out-of-pocket expenses. This payment is estimated at $50, though the actual payout may increase or decrease on a pro rata basis depending on the total number of approved claims, with an overall cap of $450.

  • Two Years of Free Credit Monitoring: All class members can sign up for two years of complimentary single-bureau credit monitoring. This service includes continuous credit score tracking, dark web monitoring, real-time credit inquiry alerts, and $1 million in identity theft insurance coverage.

Approved cash compensation will be disbursed digitally via Zelle or through a traditional paper check mailed to your address, based on the payment option you select on your claim form.

Who Is Eligible to File a Claim for Settlement Money?

You may be eligible to participate in the ABC Legal Services settlement if you fulfill the following criteria:

  • You reside in the United States.

  • Your personal, financial, or government identification information was potentially compromised in the ABC Legal Services data security incident discovered in November 2024.

  • You received an official data breach notification letter or email from ABC Legal Services regarding the incident.

Because eligibility is determined by official records maintained by the company, class members can log into the court-approved settlement website using the Unique ID and PIN included on their mailed notification letter to verify their inclusion.

Required Proof to Submit for Out-of-Pocket Loss Claims

If you are requesting reimbursement for out-of-pocket financial expenses or identity theft losses under the $5,000 claim cap, you must provide supporting documentation verifying your claims.

Acceptable forms of proof include:

  • Bank or financial account statements highlighting unreimbursed fraudulent charges, overdraft fees, or account closure costs.

  • Official police reports or Federal Trade Commission (FTC) identity theft reports documenting unauthorized activity.

  • Receipts for government fees paid to replace compromised driver’s licenses or state identification cards.

If you are applying only for the pro rata cash payment (estimated at $50) or the two-year credit monitoring service, no third-party receipts or bank statements are required.

Critical Filing Deadlines and Upcoming Court Hearing Dates

If you are an affected class member, make sure to keep track of these procedural deadlines to protect your rights:

  • Opt-Out or Exclusion Deadline: Class members who wish to remove themselves from the settlement to preserve their right to sue individually must postmark their request by August 28, 2026.

  • Objection Deadline: Class members who want to object to the terms of the settlement while remaining in the class must submit their filing by August 28, 2026.

  • Claim Form Submission Deadline: All claim forms must be submitted online or postmarked by September 28, 2026.

  • Final Approval Hearing: The federal court will hold a final fairness hearing on October 26, 2026, to evaluate whether to grant final approval to the settlement agreement.

  • Payment Distribution: Settlement checks and digital payments will be issued to approved claimants after the court grants final approval and all potential legal appeals are fully resolved.
