FN Logistics LLC has agreed to pay $5.57 million to resolve a class action lawsuit alleging the company violated California labor laws by failing to pay minimum and overtime wages, denying meal and rest breaks, and failing to reimburse business expenses for California workers.

If you worked as an hourly worker or temporary staffing employee for FN Logistics in California, you may be eligible to receive a cash payout from this settlement.

What Prompted the FN Logistics Class Action Lawsuit?

The lawsuit, titled Griselda Dunia Bucio et al. v. FN Logistics LLC, was filed in California state court alleging that the logistics provider systematically violated several provisions of the California Labor Code. FN Logistics serves as a primary fulfillment and logistics operator in California, managing warehousing and distribution networks.

According to court filings, the plaintiffs alleged that FN Logistics failed to accurately record all hours worked, resulting in unpaid minimum wages and overtime. Workers claimed they were regularly required to perform tasks off the clock, were deprived of uninterrupted 30-minute meal breaks and 10-minute rest periods, and were not properly reimbursed for necessary work-related expenses.

Additionally, the lawsuit alleged that the company issued inaccurate itemized wage statements and failed to pay all wages due upon employee termination. The claims extended to both direct hourly employees and temporary staff placed at FN Logistics facilities through third-party staffing agencies.

FN Logistics denies all allegations of wrongdoing, maintaining that its pay practices and workplace policies complied fully with California labor laws. Both parties agreed to the $5.57 million settlement to eliminate the expense, delay, and uncertainty associated with ongoing litigation.

How California Labor Laws Protect Everyday Workers

California maintains some of the most robust worker protection statutes in the United States. Under state regulations, non-exempt hourly employees are entitled to strict overtime pay rules, mandatory meal and rest breaks, and full reimbursement for expenses incurred while performing job duties.

When logistics and warehouse operations fail to adhere to these standards, workers bear the financial burden. Off-the-clock expectations, shortened meal breaks, and uncompensated expenses directly reduce a worker’s hard-earned income.

Key Allegations in the FN Logistics Settlement:
• Unpaid overtime and minimum wages
• Missed or short meal and rest periods
• Unreimbursed business expenses
• Inaccurate itemized pay stubs
• Civil penalties under California's PAGA framework

Legal actions brought under state labor codes and the Private Attorneys General Act (PAGA) give everyday people a way to hold large employers accountable for systemic payroll practices and recover earned compensation.

Cash Payouts Available to Eligible Workers

The $5.57 million gross settlement fund will cover class member payouts, court-approved attorneys’ fees up to $1,947,750, litigation costs, administrative fees, representative service awards, and $200,000 allocated toward civil penalties under PAGA (75% of which goes to California’s Labor and Workforce Development Agency and 25% to eligible PAGA class members).

The net settlement fund will be distributed to class members as cash payments on a pro-rata basis:

  • Class Member Payments: Cash distributions will be calculated based on the total number of workweeks an individual worked for FN Logistics during the covered class period. The more workweeks you accumulated, the higher your relative payout.

  • PAGA Payments: Qualifying PAGA class members will receive an additional payout based on the number of pay periods worked during the PAGA eligibility window.

You do not need to prove specific financial loss to participate; distributions are calculated based on company employment records. Cash payments will be sent automatically to individuals who received direct notice, while other eligible workers can submit a claim.

Who Is Eligible to Receive Settlement Money?

You may be eligible to receive compensation if you fall into one of the following settlement categories:

  • General Settlement Class: You worked as a current or former hourly, non-exempt employee for FN Logistics LLC (or its predecessor, FN Logistics Inc.) in California at any time between January 13, 2019, and December 31, 2024.

  • Temporary & Staffing Agency Class: You worked as a temporary employee placed at any FN Logistics facility in California through a staffing agency between January 13, 2019, and December 31, 2024.

  • PAGA Class: You worked for FN Logistics in California at any time between October 2, 2021, and December 31, 2024.

How to Submit Your Claim or Verify Your Payout

If you received a formal settlement notice by mail, you do not need to take action to receive your payout. A check will automatically be mailed to your address on file after the court grants final approval.

If you worked for FN Logistics during the eligible period but did not receive a direct notice in the mail, you must submit a claim form to participate:

  • Submit Required Proof: If submitting a claim manually, you must provide supporting documentation such as pay stubs, W-2 forms, or agency placement records showing the workweeks you completed.

  • Filing Methods: Claim forms can be completed online or downloaded, printed, and mailed directly to the settlement administrator at Bucio v. FN Logistics, LLC Settlement Administrator, P.O. Box 26170, Santa Ana, CA 92799-9958.

Important Deadlines and Final Hearing Dates

Workers who are part of the settlement should take note of these key court deadlines:

  • Claim Submission Deadline: All claim forms and supporting workweek documentation must be received by October 26, 2026.

  • Exclusion (Opt-Out) Deadline: Class members who wish to exclude themselves from the settlement to preserve individual legal rights must postmark their request by December 1, 2026.

  • Objection Deadline: Class members wishing to object to the settlement terms must submit written objections by December 1, 2026.

  • Final Approval Hearing: The court will hold a final fairness hearing on December 1, 2026, to evaluate the settlement and consider final approval.

  • Payment Distribution: Checks will be distributed following final court approval and the resolution of any potential appeals.

Take Action to Stand Up for Your Rights

When companies fail to comply with state wage and hour protections, workers deserve compensation for their time and labor. Class action settlements give workers a collective platform to reclaim uncompensated wages without taking on personal litigation costs.

If you worked for FN Logistics in California between 2019 and 2024, ensure your contact information is updated with the settlement administrator or submit your claim before the October 26, 2026 deadline
