Elon Musk’s xAI and SpaceX Hit With Environmental Class Action Over "Intolerable" Mississippi Power Plant Noise

A proposed environmental class action lawsuit, Haley et al. v. X.AI Corp. et al. (Case No. 3:26-cv-00148), has been filed against X.AI Corp., Space Exploration Technologies Corp. (SpaceX), and MZX Tech LLC.

A new environmental class action lawsuit alleges that artificial intelligence company xAI, along with its parent company SpaceX, is severely harming the lives of nearby residents by blasting “persistent, excessive, and intolerable” industrial noise from a Southaven, Mississippi power plant. The legal action claims the facility operates around the clock to generate energy for massive Tennessee data centers used to train the Grok AI chatbot.

For families living in quiet residential neighborhoods, home should be a sanctuary from the chaos of the outside world. However, residents living near the facility located at 2875 Stanton Road South in Southaven claim their peace has been completely shattered. This federal lawsuit, Haley et al. v. X.AI Corp. et al., filed under case number 3:26-cv-00148, alleges that the companies have failed to install appropriate sound mitigation measures, prioritizing corporate profits over the health, safety, and property rights of everyday people.

The legal complaint details a stark conflict between cutting-edge tech infrastructure and basic community well-being. According to the plaintiffs, the industrial complex generates an inescapable, jet engine-like roar that causes both physical vibrations and psychological distress. By uniting through a class action lawsuit, affected community members in Southaven and neighboring Horn Lake are choosing not to stand alone against a multi-billion-dollar tech empire.

The Connection Between Grok AI Data Centers and Mississippi Noise Pollution

To understand why a prominent artificial intelligence venture is running a heavy industrial power plant in Mississippi, it helps to examine the immense energy infrastructure required by modern technology. The lawsuit names three distinct corporate entities as defendants: X.AI Corp., its parent company Space Exploration Technologies Corp. (commonly known as SpaceX), and MZX Tech LLC, an entity allegedly managed by xAI to handle transactions at the facility.

According to court documents, the Southaven power plant contains dozens of loud, gas-fired turbines and massive industrial cooling systems. This machinery operates for one primary purpose: to generate massive amounts of electricity to feed xAI’s giant data centers in nearby Memphis and Whitehaven, Tennessee, known as “Colossus I” and “Colossus II.” These supercomputers run non-stop to train and power xAI’s large language model, Grok.

Because advanced artificial intelligence systems demand a constant, uninterrupted stream of high-voltage energy, these gas-fired turbines run 24 hours a day, seven days a week. The lawsuit notes that because the plant operates “all day, every day,” it continually blasts disruptive sound frequencies into neighboring residential sectors, parks, and local schools, depriving everyday people of the full use and quiet enjoyment of their properties.

Residents Describe Living Next to an Industrial Sound Blanket

The legal complaint paints a vivid picture of how the noise pollution has tormented local property owners since the Southaven power plant first went online in August 2025. Neighborhood residents have frequently compared the continuous emissions to the sound of a jet engine permanently idling nearby. The acoustic profile is described as a distressing combination of high-pitched squealing, constant whining, an intense roar, and a low-frequency tonal hum.

Worse still, the low-frequency noise doesn’t just impact a person’s hearing—it creates a physical sensation. Plaintiffs allege that the deep, industrial vibrations can be felt inside their homes, mimicking the heavy bass rattle experienced at a live music concert. The filing emphasizes that this auditory intrusion is particularly unbearable at night when ambient neighborhood sounds die down and families are actively trying to sleep.

The persistent disruption has reportedly caused a wide variety of physical and psychological symptoms among community members. Residents report experiencing ongoing anxiety, extreme irritability, heightened stress levels, chronic headaches, nausea, and tinnitus (ringing in the ears). Environmental experts cited in the filing note that even when low-frequency or tonal sounds are not consciously audible, continuous low-level exposure still triggers adverse biological responses and long-term health complications.

Forced Lifestyle Changes and Plummeting Property Values

The continuous roar from the xAI facility has allegedly forced local families to fundamentally alter how they live their lives. According to the 62-page complaint, plaintiffs can no longer open their windows for fresh air, handle routine yardwork, or allow their children to play outside. Simple pleasures like relaxing in the backyard, watching local wildlife, or lounging outdoors have become completely impossible due to the overwhelming volume.

In addition to the immediate physical toll, the industrial complex has introduced severe financial anxieties for local homeowners. Many residents are deeply concerned that their property values have cratered as a direct result of the surrounding noise. The lawsuit highlights the desperation of the neighborhood, pointing to one resident who lamented that they likely “couldn’t give away” their home because of the pervasive noise pollution.

To back up their claims with hard data, local property owners have independently measured the sound levels emanating from the xAI facility. These tests have reportedly revealed that noise levels regularly exceed 70 A-weighted decibels (dBA) at residential property lines. The lawsuit notes that these readings represent a direct violation of Southaven’s local noise ordinance, meaning the tech companies are operating outside of established municipal legal boundaries.

Rapid Industrial Expansion: More Turbines and More Profit

What began as a localized inconvenience has rapidly escalated into a widespread community crisis, according to the legal filing. When the Southaven plant first opened its doors, xAI described the original three gas-fired turbines as merely “temporary” fixtures. However, rather than phasing them out, the companies have kept them running for nearly a year while aggressively expanding the facility footprint.

The speed of the industrial build-out has caught many neighbors off guard. The complaint reveals that as of May 2026, the defendants had dramatically increased the number of temporary turbines spinning at the Southaven plant from three to a staggering 57. Each additional turbine has steadily amplified the noise footprint, compounding the ongoing distress felt by families living downwind of the facility.

To make matters worse, the lawsuit notes that on March 10, 2026, MZX Tech LLC secured an official permit allowing the construction of 41 permanent turbines on the Stanton Road South property. The plaintiffs emphasize that the companies obtained this permanent expansion approval without offering any meaningful assurances or engineering designs to demonstrate that they will actually reduce the immense volume of sound escaping into the community.

Who May Be Eligible to Join the xAI and SpaceX Noise Lawsuit?

If your daily life, health, or property value has been negatively impacted by the constant operation of this AI power plant, you may be eligible to participate in this legal action as a class member. The lawsuit aims to establish a strictly defined geographic boundary to protect the property owners and renters who are bearing the brunt of the noise pollution.

According to the complaint, you may be eligible to participate if you have owned residential property or resided at any point between August 2025 and the present within the following specific Mississippi boundaries:

  • Northern Boundary: Stateline Road West

  • Eastern Boundary: U.S. Highway 51

  • Southern Boundary: Nail Road

  • Western Boundary: A vertical line positioned exactly one mile west of Horn Lake Road.

This geographical zone encompasses substantial portions of both Southaven and Horn Lake. If your home falls within this grid, you are considered part of the proposed class of affected residents fighting to protect their neighborhoods from unauthorized industrial intrusion.
