Tesla Agrees to Class Action Settlement Over "Idle" Fees Charged to "Free" Lifetime Supercharging Owners

Tesla, Inc. has agreed to a class action settlement resolving allegations that the electric vehicle manufacturer unlawfully charged Supercharger “idle” fees to California drivers who purchased vehicles promised with free lifetime Supercharging.

The court granted preliminary approval to the deal on June 25, 2026, creating a path for eligible owners to secure full refunds for paid idle fees, cash payments of up to $350, and guaranteed restoration of their Supercharging access.

Why Was Tesla Sued Over Supercharger Idle Fees?

The class action lawsuit, Shenkman v. Tesla, Inc., centered on promises made to early Tesla buyers regarding public fast-charging access. When marketing its premium electric vehicles, Tesla enticed many early adopters by offering free lifetime Supercharging. However, the lawsuit alleged that Tesla later improperly imposed “idle” fees on these drivers—charging extra whenever a vehicle remained plugged into a Supercharger for more than five minutes after its charging session was complete.

According to the complaint, Tesla went a step further by disabling—or threatening to disable—Supercharger access entirely for drivers who refused or failed to pay these disputed idle fees. Plaintiffs argued that charging idle fees and cutting off Supercharger connectivity violated original vehicle purchase agreements and misled consumers who had paid upfront for unlimited, lifetime charging privileges.

While Tesla denies any wrongdoing or legal liability, the automaker agreed to enter into the class action settlement agreement to resolve the claims and avoid the time, risk, and expense of continued court litigation.

Who Is Eligible to Claim Benefits Under the Tesla Settlement?

You may be eligible to participate in the settlement and claim cash benefits if you meet specific geographic, ownership, and purchase agreement criteria set by the court.

According to official court documents, you are a settlement class member if:

  • You purchased a Tesla vehicle in California before December 16, 2016;

  • You continued to own the vehicle after December 16, 2016;

  • You resided in California as of June 21, 2021; AND

  • Your Motor Vehicle Purchase Agreement described your car as “Supercharger Enabled,” “Supercharger Hardware,” or “Supercharger Hardware & Access.”

The settlement administrator has utilized Tesla’s internal corporate records to identify affected vehicle owners. If you owned or currently own multiple eligible Tesla vehicles, you must submit a separate claim form for each vehicle to receive full settlement benefits.

What Cash Refunds and Benefits Can You Receive From Tesla?

The settlement structure offers both cash payouts and non-cash account remedies depending on whether you still own your Tesla and whether your vehicle experienced charging access suspensions.

1. Full Refund of Paid Idle Fees

Settlement class members who submit a valid claim form can receive a 100% refund of all Supercharger idle fees they actually paid to Tesla prior to the settlement execution date. The settlement administrator will determine your exact refund amount using Tesla’s official accounting records.

2. Disabling Compensation (Up to $350 Cash)

If Tesla disabled your vehicle’s Supercharger access due to unpaid idle fees or associated charges, you can claim significant cash compensation:

  • $50 Cash Payment: If Tesla disabled your Supercharger access for less than 30 consecutive days.

  • $350 Cash Payment: If Tesla disabled your Supercharger access for 30 or more consecutive days. (Claimants selecting this benefit must identify the approximate year or years the 30-plus day outage occurred.)

3. $10 Cash Payment for Former Owners

If you previously owned an eligible Tesla model but no longer own it, you can elect on your claim form to receive a flat $10 cash payment.

4. Restoration of Access and Waiver of Unpaid Fees

For class members who currently own an eligible Tesla, Tesla has agreed to waive all unpaid idle fees incurred up to the date of the settlement. Additionally, Tesla will not disable Supercharger access for these vehicles due to past fees and will immediately restore access if it was previously shut off. However, the settlement agreement does not prevent Tesla from assessing idle fees incurred moving forward after the agreement’s execution date.

Understanding Contract Law and Consumer Advertising Protections

When major corporations issue contractual promises—such as lifetime access or included vehicle features—consumer protection laws hold them accountable to those terms. Under basic breach of contract and false advertising principles, companies cannot retroactively alter purchase agreements or attach unexpected operational fees to services originally represented as free.

When automakers deploy software locks or network access restrictions to enforce disputed fees, everyday consumers face severe disruptions to their daily transportation needs. Class action litigation levels the playing field, ensuring that drivers do not stand alone when fighting unfair account locks or unexpected corporate charges.

How to Submit Your Tesla Idle Fee Claim Before the Deadline

To secure a cash refund or account remedy, eligible class members must submit a valid claim form before the strict court cutoff date.

Follow these steps to file your claim:

  1. Locate the official settlement notice mailed or emailed to you, which contains your unique Login ID and PIN.

  2. Visit the official court-approved settlement website at TeslaIdleFeeClassAction.com.

  3. Fill out the online claim form using your credentials, or download a printable PDF claim form to complete and mail to: Tesla Idle Fee Class Action Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958.

  4. If you no longer have your Login ID and PIN, contact the settlement administrator by emailing info@TeslaIdleFeeClassAction.com with your full name and mailing address.

  5. Submit your claim online or ensure your mailed claim form is postmarked no later than September 25, 2026.

The court will hold a final approval hearing on December 2, 2026, to decide whether to approve the settlement terms. Monetary payouts will be distributed approximately 60 days after the court grants final approval and any potential legal appeals are resolved.
