Medical device manufacturers Permobil Inc. and Max Mobility LLC have agreed to a $4.1 million class action settlement to resolve claims that they manufactured and distributed defective SpeedControl Dials for the SmartDrive MX2+ Power Assist Device.

Manufacturer Permobil, Inc. and Max Mobility LLC agreed to the fund to resolve claims that the rotary controllers suffered from a critical design defect that led to an August 2025 product recall.
The settlement resolves a class action lawsuit filed in federal court following a nationwide recall of the SpeedControl Dial rotary controllers. The devices are engineered for manual wheelchair users, allowing them to adjust speeds, start, and stop the SmartDrive MX2+ Power Assist system.
According to court documents, plaintiffs alleged that Permobil and Max Mobility manufactured and sold defective controllers that violated the Magnuson-Moss Warranty Act. The lawsuit claimed that a underlying design flaw could cause the motor to exhibit “unexpected behavior,” creating an operational hazard that put wheelchair users at risk of sudden loss of control or physical injury. In August 2025, the manufacturers officially recalled the affected units, prompting consumers to seek financial compensation for out-of-pocket expenses and diminished product value.
The $4.1 million settlement fund provides two main forms of monetary relief for affected consumers depending on whether they incurred verifiable repair or replacement expenses.
Out-of-Pocket Expense Reimbursements (Up to $1,000): Class members who paid out-of-pocket to repair or replace their recalled SpeedControl Dial can submit a claim with proof of purchase to receive up to $1,000 in reimbursement. Eligible proof includes receipts, invoices, or official repair documentation. If total valid reimbursement claims across all class members exceed $100,000, individual payments will be adjusted on a pro-rata basis.
Pro-Rata Cash Payout (No Proof Required): All eligible class members can submit a claim form to receive a standard cash payout from the remaining settlement fund without needing to submit receipts or financial documentation. The final amount of each non-proof cash payment will depend on the overall number of valid claims submitted.
You may be eligible to participate in the settlement and receive a financial payout if you meet the following conditions:
You reside in the United States or any of its territories.
You purchased or were distributed a SpeedControl Dial for the SmartDrive MX2+ Power Assist Device for personal, family, or household use.
Your purchase or distribution occurred between April 1, 2022, and July 1, 2026.
If you received the device as part of your mobility equipment during this four-year window, you are considered a settlement class member and have the right to file a claim.
To secure a cash payout or reimbursement for repair costs, you must file a valid claim form before the upcoming court deadline.
Claim Filing Deadline: All claim forms must be submitted online or postmarked by mail no later than August 31, 2026.

Final Approval Hearing: The court will hold a final approval hearing on October 29, 2026, to review the settlement terms. Monetary compensation will be distributed to eligible class members only after the court grants final approval and any legal appeals are settled.
